Wrong Side of History

Montana lawmakers who have spent the entirety of their paltry careers voting against equality now find themselves on the wrong side of history.  In the wake of the upcoming supreme court decision on equal marriage, no one who reads a newspaper can come to any other conclusion.  Even Rush Limbaugh says marriage equality is inevitable.

The nutjob wing of Montana’s Republican Party  aren’t just wrong, they’re way out in right field, and soon to be there alone.   Montana is one of only four states that has a law on the books that makes being gay an imprisonable offense.  This fact alone is despicable, but when you consider what else the Montana Legislature has done you start to wonder if the Montana legislature isn’t among the most bigoted in America.

Consider this: During the past 21 legislative sessions least 32 bills have been introduced to make all Montanans equal under the law.  Some, like Sen. Facey’s SB 107 attempted to repeal the “deviate sexual conduct” law, others would have prevent discrimination in housing, or stopped the bullying of young people in schools. Many have been introduced by Sen. Christine Kaufmann, of Helena.

Not a single one of these bills has ever passed in the history of this state.

But it’s worse than that.  The Montana legislature isn’t content with blocking equality bills.  They’ve tried year after year to make things worse.
Montana LegislatureLook what they did in 1995, when Republican Senator Rick Holden added an amendment to a bill to require gay men and lesbians to register as felony sex offenders. Democrats tried to remove the amendment, but 32 of 50 Senators voted to keep it in.

It was only after twenty-four hours of scathing national press coverage from CNN that the Republicans were finally forced to take the sex offender amendment out. But not before Billings GOP Sen. Al Bishop decided to share his beliefs with the world.  He said consensual activity between people of the same sex was “a worse offense than rape.” (The bill was HB 214 and predates the online legislative search.)

Anyway, the Chick-Fil-A munching bunch was not happy to be denied a “felony sex offender registry” of gay citizens. A couple of days later anti-gay slurs and graffiti were “scrawled across the doors of the capitol, and a famous statue was defaced. With no sense of irony, and no mention of the anti-gay nature of the spray-painted slogans, Senators introduced a bill to make defacing the capitol a felony.”

And who could forget what happened ten years later in 2005, when the all-day kindergarten was opposed by religious right Repubs, who claimed bill was part of the “gay agenda.” “The purported evidence given by these groups was that gay activists were NOT at the hearing, proving it was part of the activists’ secret agenda.”

Public sentiment is now so firmly behind equality that the reaction to democratic politicians who announce their support at this late date ranges from “who isn’t” to “where were you earlier.”  The Montana Senate even voted, finally, to erase our “anti-sodomy law” which makes it an imprisonable crime to be gay.  Although invalidated by our state supreme court in 1997, the law has remained on our books because Republicans have always refused to go along with efforts to scrap it.

Now, SB 107, a measure to strike the offensive language from our statutes finally passed the senate.  That said, the vote was far from unanimous.  Ten Republicans voted no.

Any day now the bill will be voted on in committee, and then on the Floor of the House.  No assumptions can be made about body which includes Verdell Jackson, Krayton Kerns, David Howard and Jerry O’Neil, so start contacting  the lawmakers in the House of Representatives, which you can do via this online form. Conservatives were on the wrong side of history with women’s suffrage, they were on the wrong side of segregation.  Let’s see whose side they’re on now.

Medicaid Gets its Day in Court

The big story in the Montana legislature this coming week will be the showdown over what is known as Medicaid Expansion. There’s a hearing on Monday for HB 590.

Governor Bullock included it in his budget and has been touring the state promoting it, and numerous bills have been introduced to address or defeat it. It’s one of his signature proposals this session. Republicans are trying to oppose it because it is a new federal spending item, which is something Republicans profess to hate (except when it’s in the form of farm subsidies).

There’s also a lot of noise about it, many false arguments, and a good deal of misinformation.   So here is an explanation which I hope is helpful to my readers and especially to avocates.

It’s actually pretty simple.  If the Governor’s proposal is voted up and made law, Montana will receive roughly $750 million a year of new federal money into our healthcare system for the next eight years.  It will go into the state Medicaid program, and when it is spent it will not only give medical coverage to 70,000 additional citizens but will also be a huge boon to our economy and to many Montanans who will now have access to medical care–especially people working in agriculture, construction or tourism jobs. And the money will also help business owners avoid a tax under Obamacare that is levied on businesses of a certain size who do not provide health benefits to workers.

If it is defeated, this $750 million will instead go to other states.

And that’s the basic story.

The Affordable Care Act, a.k.a. Obamacare, allows states to “opt in” to this new federal Medicaid increase.  Medicaid is the program by which the lowest income people (mostly kids and seniors) in Montana get medical care.  This new addition of funds to the program, if Montana accepts it, will allow a new class of people–the working poor, such as many dishwashers, farm workers and day care workers–to be eligible for Medicaid.   if we so chooseAnd the state will not have to. match these payments at all.  Montana currently shares the cost of Medicaid with the Feds, but this expansion will be entirely covered for three years by the annual $800 million. After the first three years, we will be required to match about 7%.

A few right-wing imbeciles, including Governors like Bobby Jindal in Louisiana (who is suffering under the delusion that he might get the GOP nomination for president in 2016), are “making a stand” and refusing this federal cash.  This is what some conservative Governors did with the stimulus money back a few years ago.  It’s a move that conservatives employ to beef up their Tea Party bona fides. To refuse federal assistance is to prove one’s aversion to Obamacare, and thus one’s manhood.

The problem is that Jindal, by doing this, is not preventing federal tax money from being spent.  Instead, it simply goes to the other states who are opting in. They will get a sweeter deal.

And Jindal is royally screwing business owners in his state.  Obamacare (which is now the law of the land, whether you like or not), will require large businesses to pay a $2,000 tax for each person the business employs but does not give health benefits to–amounting to a $15 million tax increase in Montana.  But if we get the $750 million and thus increase the Medicaid eligibility, these businesses will be spared.

And of course, if we accept this federal money it will heavily boost the Montana economy.  It is expected to create 13,000 new jobs, not only in the healthcare industry but in ancillary industries.

For these reasons, many conservative Republican governors have approved the expansion of Medicaid in their states, such as Jan Brewer (AZ), John Kasich (OH), Chris Christie (NJ), Susana Martinez (NM), and even Tea Party poster boy Rick Scott (FL) among several others.   Actually, North Dakota governor Jack Darwhimple, also a Republican, has endorsed it too. He’s taking the cash. North Dakota is a state that the Montana GOP is constantly saying we should try to emulate.  Nineteen states have already indicated they’re expanding Medicaid – eight are Republican.

In a funny twist, hospitals executives, doctors and nursing home executives–who generally whine about Obamacare and like to support politicians who whine about it–are now hoping that the Medicaid expansion is passed by the Montana legislature, by their Republican pals who control the House and Senate.  This is why Bullock has been visiting hospitals and communities with big health industries, including those represented by Republican legislators.  He is letting these communities know that their Republican representatives, who claim to care about jobs and the economy in their districts, are not doing their job and are actually considering denying these communities the federal money, which would then go to other states.

And while you would think that these medical industry players would have influence in the Capitol to get a few votes from the GOP, don’t be so sure.  The lobbyists for the healthcare industrial complex who hang out at the legislature do little more than drink lattes, go to cocktail parties with their GOP legislator pals, commiserate with them about Obama, and during election season make campaign donations to them.  They have so far shown no ability to get votes, which is another way of saying that if Medicaid expansion fails, they should all be fired.    Because Democrats are already on board.

And always remember Bob Wagner, may his political career rest in peace. Wagner voted against stimulus money for his district, because he felt it was the Tea Party thing to do.  He got primaried by a moderate Republican, who used the vote him, and Wagner was roundly defeated.  If Medicaid expansion fails due to similar conservative shenanigans, there will be many more Bob Wagners in 2014.

Much Ado About Nothing

A terrible thing will soon happen in Montana. It is a nightmare: as reported in the Helena IR today, there will soon be a website which will advertise low-cost health insurance plans, affordable to people who cannot presently afford to buy insurance. These plans will be offered by private companies, but listed comprehensively for one-stop easy shopping on the web by the federal government, courtesy of Obamacare.

Montana Wingnuts Jump to Defend “Legitimate Rape” Comments

A leader of the Montana Constitution Party defended Todd Akin’s claim that women don’t get pregnant from legitimate rape in the Missoulian this week.  Marilyn Hatch, of Lolo, says real rape victims don’t get pregnant because:

5. There can be disruption of the ovulation cycles due to the extreme emotional trauma. (A. Helligers, U.S.C.C. AB Conference, Washington, D.C., October 1967).

6. One study shows there is 58 percent “sexual dysfunction” (no penetration, or retarded or premature ejaculation).

7. Another study shows that there is often no sperm deposited in the vagina.

What kind of person would defend forced pregnancy for rape victims?

Marilyn Hatch has been arrested for obstructing access to health care clinics in four states, the Missoulian reported.  Hatch also ran a fake “gold standard” bank in Victor, which she believed would help disrupt the United States banking system.  The bank, known as a “redemption center” accepted fake money called “Liberty Dollars” and exchanged them for gold and silver.  The Montana Human Rights Network has a great report on Hatch’s wingnut activities.

Of course, Hatch is not the only Montana conservative to support these appalling views.  A former candidate for chair of the Montana Republican party,  Rick Breckenridge, is also on the record defending Akin’s views. Breckenridge’s  Facebook page reads “Hang in their Atkin [sic].” He also claims on Facebook that he knows “several victims of rape who did not get pregnant.”

Besides his candidacy for GOP party chair,  you might remember Rick Breckenridge as a platinum sponsor of the “Liberty Convention 2010”.  As Cowgirl readers recall, this was the conference in Montana that sparked an FBI investigation into an anti-government plot to kill Alaska state troopers.  Media Matters reported that the FBI got involved after one of the conferences speakers bragged to the audience about commanding a 3,500 strong armed militia and creating a new court system to supplant federal courts.

People like Breckenridge and Hatch are classic examples of the kind of people who hold these views.  Which is why it’s so disurbing that  Congressman Rehberg sent Akin $5,000 bucks and that Tim Fox and Congressman Hill share Akin’s views on forced pregnancy for rape victims.

POLITICO: Schweitzer on List of Top 5 for 2016

Politico includes Montana Governor Brian Schweitzer on it’s list of potential Democrats for the 2016 presidential ticket:

Much like Obama’s 2004 convention speech catapulted him to star status, Schweitzer’s 2008 speech also gave him credibility, buzz and recognition among party leaders. While Montana is not a swing state, its red-state credentials would help shake the liberal label the other 2016 hopefuls might carry. Schweitzer is a fresh face whose oratorical skills are an asset and a liability. U.S.News& World Report wrote last summer that Schweitzer impressed party elders across early states, already laying the groundwork for a primary slog.

 

Of course, it can’t hurt that Montana has had the highest surplus in the state’s history under Governor Schweitzer with an average ending fund balance of $414 million. The average fund balance of the eighteen years prior to Schweitzer was $54 million.

Also on the list: Joe Biden, Hillary Clinton, Andrew Cuomo, and Martin O’Malley.

BREAKING: Romney Tells Montana GOP-ers Black People “Just Want More Free Stuff from the Government”

You probably heard the news that GOP Presidential Candidate Mitt Romney was booed when he spoke to the NAACP earlier today.

Well Romney was in Montana tonight.   At a Hamilton, Montana fundraiser that anyone who dropped $50,000 per couple could attend, he gave the GOP-ers their money’s worth in Republican talking points.

Speaking of the black voters who booed him at the NAACP event, Romney told the Montana Republicans:

Remind them of this, if they want more stuff from government tell them to go vote for the other guy-more free stuff. But don’t forget nothing is really free.

REALLY?! TEA Party Lawmaker: Returning Bison to Tribes Part of Communist Plot to Drive Gas to $25/gallon

A new conspiracy is afoot in the Big Sky, according to a TEA Party Republican state legislator.

TEA Party Republican Rep. Krayton Kerns (R-Laurel) has written on his website that returning bison to the Fort Peck Indian Reservation is part of a communist plot to “crush the Republic” and drive gas prices to $25/gallon. In case you’re one of the few people who doesn’t immediately grasp the obvious connection between bison and $25 gas, Kerns kindly explains how the plot will go down.

First, Walt Disney’s cartoon “Bambi” brainwashed the masses to the extent that “state sponsored worship of the earth and creation surpassed worship of our Creator.”

Returning wild bison to the Fort Peck reservation:

“is the second of a four step process to crush the republic and bring our populace into perfect dependence on big government—just as Karl Marx dreamed”

The third step in the Marxist plot, says Kerns, is that “bison will overpopulate” and soon “thousands” will be “ravaging” the area.

Finally, Kerns rationally concludes,

“The world’s economy will grind to a halt due to instability in the Middle East driving the price of gasoline over $25 per gallon.”

Rep. Kerns is outraged that wild, genetically pure bison have returned to tribal lands on the Great Plains. The move reunites American Indians with the iconic species that has been a fundamental part of their culture and the prairie ecosystem. I’m not sure how Kerns would explain the fact that gas prices have actually gone down since the bison were returned to Fort Peck.  

Sounding the alarm about this conspiracy will no doubt be a key component of the TEA Party’s message this fall.  How anyone could believe this stuff is a puzzle, but what the TEA Party lacks in intelligence, they more than make up in rage.    When a TEA Party candidate arrives at your door this fall to share their anger over this latest conspiracy, do not panic.  Simply hold up a book, which should make any tea baggers desirous of leaving your immediate vicinity. (It works like a crucifix on vampires.)

Rep. Kerns is the same TEA Party Republican that compared Georgetown law student Sandra Fluke to a rutting bulldog.  Sandra Fluke is the woman Rush Limbaugh called a slut for asking that since Viagra is covered by insurance, so should birth control.

The Fight’s Not Over

In a memo thick with bravado but lacking in coherence, the American Tracition parthership today declared victory over Montana voters.

The ATP makes the ridiculous claim that Steve Bullock’s defense of Montana’s anti-corruption law amounts to an “indefensible attacks on Montanan’s God-given right of free political speech.” One can only assume the celebratory drinks were a little too copiously sipped.

In reality, history has shown that big money in politics buys more and corrupts faster at the state and local levels.  And so, the Supreme Court’s assertion that money is the same thing as speech makes the words “free speech” bitterly ironic.

ATP goes on to insist that they have “always adhered to every letter of applicable law.” If that’s true, one wonders what they view as inapplicable.

“The fight’s not over,” Montana Governor Brian Schweitzer said the Youtube clip for StandwithMontanans.org. “We’re going to overrule the Supreme Court with a constitutional amendment, to make it clear that we the people are in charge of America, not we the corporations. Here in the Montana we’re putting it on the ballot.”

“Corporations are people?  I’ll believe that when Texas executes one,” said the Governor.  Click here to get involved in the campaign to overturn the ruling.

As the Billings Gazette reports, ATP has also sued to strike down two other Montana laws.  Montana courts will decide whether ATP must disclose its donors.  They’ll also rule on ATP’s lawsuit to increase individual contribution limits–a change favored by the failed legislative leader and GOP Gov race dropout Jeff Essmann.  Probably Essmann hopes to give wealthy individuals more say in Montana elections. The Sanders County Republican Party has also sued the state.  The Sanders County GOPers think Republicans should have the right to endorse candidates in non-partisan judicial races.
